    Terms of Service for Airpay by Airpay Digital Space Services

    Welcome to Airpay by Airpay Digital Space Services ("Airpay," "we," "us," or "our"), a platform for booking flights, hotels, and making bill payments (the "Service"). These Terms of Service ("Terms") govern your use of our Service, including our website, mobile app, and related services. By accessing or using the Service, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use the Service.

    1. Use of the Service

    1.1 Eligibility: To use the Service, you must be at least 18 years old or have the consent of a parent or legal guardian. By using the Service, you confirm that you meet these eligibility requirements.

    1.2 Account Creation: You may need to create an account to access certain features of the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately at support@airpay.ng if you suspect unauthorized use of your account.

    1.3 Acceptable Use: You agree to use the Service only for lawful purposes and in accordance with these Terms. You may not use the Service to engage in fraudulent, illegal, or unauthorized activities, or to violate the rights of others.

    2. Booking Flights and Hotels

    2.1 Booking Process: Airpay facilitates bookings for flights and hotels through third-party providers, such as airlines and hotels. When you make a booking, you enter into a contract with the respective third-party provider (e.g., airline or hotel), and their terms and conditions will apply in addition to these Terms.

    2.2 First-Time Travelers: First-time travelers are strongly encouraged to have:

    • A return flight ticket.
    • Confirmed hotel accommodation.
    • A minimum of $1,000 for Personal Travel Allowance (PTA) or Business Travel Allowance (BTA).

    Failure to meet these requirements may result in denial of boarding or entry by airlines, immigration authorities, or other relevant entities, and Airpay will not be liable for any resulting consequences.

    2.3 Required Documents for Minors: For minors (children under 18) traveling, the following documents must be presented at the airport check-in counter:

    • An original birth certificate.
    • A consent letter from the child’s parent(s) or legal guardian(s).

    Failure to provide these documents may result in the minor being denied boarding, and Airpay will not be liable for any resulting consequences.

    2.4 Ticket Restrictions:

    • Non-Transferable: All flight tickets booked through Airpay are non-transferable at any time.
    • Non-Refundable/Non-Changeable: Some tickets may be non-refundable or non-changeable, depending on the airline’s or provider’s policies. You are responsible for reviewing the specific terms of your ticket at the time of booking.
    • Special Requirements: Certain airlines may require additional documentation, such as medical reports for pregnant passengers. You are responsible for complying with all airline-specific requirements.

    2.5 Booking Confirmation: By making a booking through Airpay, you confirm that you have read, understood, and agree to comply with these Terms, including the booking information provided. You also agree to waive any legal rights to hold Airpay liable for any issues, losses, or liabilities arising from your booking, including but not limited to flight cancellations, delays, or denial of boarding due to failure to meet airline or immigration requirements.

    3. Bill Payments

    3.1 Payment Processing: Airpay facilitates bill payments for utilities, services, or other obligations through third-party payment gateways. You are responsible for providing accurate payment details, including account numbers and amounts.

    3.2 Transaction Responsibility: You agree that Airpay is not responsible for errors, delays, or disputes arising from incorrect information provided by you or issues with third-party service providers (e.g., utility companies or payment gateways).

    3.3 Payment Confirmation: All payments are subject to verification and approval by the relevant third-party provider. Airpay is not liable for any delays or failures in payment processing beyond our control.

    4. Third-Party Services and Payment Gateways

    4.1 Third-Party Providers: The Service integrates with third-party providers, such as airlines, hotels, and payment gateways (e.g., Credo, Paystack, Flutterwave, or other regionally relevant providers), to facilitate bookings and payments. These providers operate under their own terms and conditions, which you are responsible for reviewing.

    4.2 No Liability for Third Parties: Airpay is not responsible for the actions, policies, or performance of third-party providers, including but not limited to flight cancellations, hotel booking issues, or payment processing errors. Any disputes with third-party providers must be resolved directly with them.

    5. Fees and Payments

    5.1 Pricing: All prices for flights, hotels, and bill payments are as displayed on the Service, subject to change by third-party providers. Additional fees, such as taxes, service charges, or airline fees, may apply and will be disclosed at the time of booking or payment.

    5.2 Payment Authorization: By providing payment information, you authorize Airpay and its third-party payment gateways to process transactions for the amounts due, including any applicable fees.

    5.3 Refunds: Refunds for bookings or payments are subject to the policies of the relevant third-party provider (e.g., airline, hotel, or utility company). Airpay will process refunds only when authorized by the provider and in accordance with their terms.

    6. Cancellations and Modifications

    6.1 Flight and Hotel Bookings: Cancellations or modifications to bookings are subject to the terms of the third-party provider. Some bookings may be non-refundable or non-changeable. You are responsible for reviewing these terms before completing a booking.

    6.2 Bill Payments: Once a bill payment is processed, it may not be reversible. Any disputes or requests for refunds must be directed to the relevant service provider.

    7. Limitation of Liability

    To the fullest extent permitted by law, Airpay and its affiliates, officers, employees, or agents will not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from:

    • Your use of or inability to use the Service.
    • Errors, delays, or disruptions caused by third-party providers.
    • Failure to meet travel requirements, such as documentation or allowances.
    • Unauthorized access to your account or personal information, except where caused by our gross negligence.

    By using the Service, you agree to waive all rights to hold Airpay liable for any liabilities, losses, or damages arising from your use of the Service or third-party provider actions.

    8. Indemnification

    You agree to indemnify and hold Airpay, its affiliates, officers, employees, and agents harmless from any claims, losses, damages, or expenses (including legal fees) arising from your use of the Service, violation of these Terms, or failure to comply with third-party provider requirements.

    9. Termination

    We reserve the right to suspend or terminate your access to the Service at our discretion, with or without notice, for reasons including but not limited to violation of these Terms, fraudulent activity, or misuse of the Service.

    10. Changes to These Terms

    We may update these Terms from time to time to reflect changes in our practices or legal requirements. Your continued use of the Service after such changes constitutes acceptance of the revised Terms.
